Application of these Promotion Terms

1. 1. These Promotion Terms apply to Mirai Legal's "Brisbane Small Business Black Friday / Cyber Monday 2020 Promotion" (the Promotion).

   2. The Promotion Period starts at 9:00am Friday 20 November 2020 and ends at 5:00pm Monday 30 November 2020 (Australian Eastern Standard Time), unless otherwise extended or withdrawn by Mirai Legal.

   3. Mirai Legal has the right to modify, limit availability, or withdraw, the Promotion (including varying these Promotion Terms) at any time at its sole discretion. Any variation to these Promotion Terms will be posted on our website.

The Offer

1. 1. The Offer is a discount of 10% Off Mirai Legal's standard professional fees for preparation and filing of one or more new trade mark application(s) with IP Australia on behalf of an Eligible Client.

   2. The discount provided under the Offer applies to Mirai Legal's professional fees only and does not apply to:

      1. disbursements, outlays and other chargeable expenses;

      2. government fees, including IP Australia filing or service request fees;

      3. other legal services, including any legal work performed subsequent to the preparation and filing of the relevant trade mark application(s);

   3. The discount provided under the Offer is not transferrable, refundable or redeemable for cash.

   4. This Offer cannot be combined with any other promotion, discount or offer.

Eligibility

1. 1. The Offer is available to approved clients only. It is only available to Eligible Clients as determined by Mirai Legal under this clause.

   2. To become an Eligible Client, you must:

      1. be a member of the Brisbane Small Business Directory (brisbane​small​business​.com​.au) and/or the Brisbane Small Business Facebook Group (facebook.com/​groups/​brisbane​small​business) during the Promotion Period. Mirai Legal has the right to require satisfactory proof of membership at its discretion;

      2. make an enquiry to Mirai Legal before the end of the Promotion Period mentioning the Offer;

      3. be approved by Mirai Legal;

      4. accept these Promotion Terms and enter into a Costs Agreement with Mirai Legal for the relevant legal services; and

      5. deposit the amount required by Mirai Legal for anticipated professional fees and disbursements to Mirai Legal's Trust Account.

   3. You acknowledge that:

      1. the Promotion is on the express basis that Mirai Legal is not bound to provide legal services or representation to any person and Mirai Legal may decline to act for any person at its sole discretion;

      2. the legal services relating to the Offer may not be available or suitable for your particular needs, objectives or circumstances;

      3. the application for registration of a trade mark is a legal process involving the creation and protection of legal rights. Successful registration is subject to the applicant and the relevant trade mark meeting legally-defined timelines, eligibility, statutory requirements and other criteria. The filing of an application for a given trade mark does not guarantee that the application will be accepted for registration or successfully registered.

   4. A limit of one Offer or discount per Eligible Client applies.

General

1. 1. The law of Queensland applies to these Promotion Terms.

   2. The Offer is subject to Mirai Legal's Terms of Retainer. Mirai Legal's Terms of Retainer will prevail to the extent of any inconsistency with these Promotion Terms.

   3. Collection and handling of personal information is subject to Mirai Legal's Privacy Policy.
